Terms of service

The agreement governing your use of the Klystrax website, Studio, account dashboard, and API.
Last updated: 17 October 2026

1. Agreement and service operator

These Terms form a binding agreement between you and the operator of Klystrax for access to klystrax.com, Klystrax Studio, the account dashboard, and the OpenAI-compatible API (together, the “Service”). By creating an account, purchasing credit, or using the Service, you agree to these Terms and the Privacy Policy.

Klystrax provides access to third-party artificial-intelligence models and related account, billing, and integration tools. Klystrax is an independent service and is not affiliated with OpenAI or the makers of compatible client applications unless expressly stated.

2. Eligibility and authority

You must be at least 18 years old, or the age of legal majority where you live, and legally able to enter this agreement. If you use the Service for a company or other organization, you confirm that you have authority to bind it and that “you” includes that organization.

3. Accounts and verification

Provide accurate, current information, maintain one account per person or organization unless Klystrax approves otherwise, and keep your sign-in credentials secure. You are responsible for activity performed through your account until you notify us of unauthorized access.

Email verification and one-time codes may be required for registration, password recovery, or sensitive account actions. We may request additional information reasonably needed to prevent fraud, comply with law, or establish account ownership.

4. API keys and customer systems

API keys are confidential credentials. Store them in a secret manager or server-side environment variable, never expose them in public code or a browser bundle, and revoke a key immediately if it may be compromised. You are responsible for requests made with your active keys and for configuring any client, agent, tool, or application that connects to the Service.

Klystrax may impose reasonable limits on active keys, request size, rate, context length, output, or concurrent use to protect the Service and other customers.

5. AI models and service availability

Models, capabilities, context limits, prices, and upstream providers may change. A listed model may be paused or removed when it is unavailable, unsafe to operate, incorrectly priced, or no longer supported. The Service may also be interrupted by maintenance, capacity limits, internet failures, or third-party incidents.

We aim to provide reliable access but do not promise uninterrupted, error-free, or permanent availability of any model or feature. No service-level agreement applies unless separately agreed in writing.

6. Prepaid credits and pricing

Klystrax uses prepaid, usage-based billing. Current token rates, supported currencies, minimum top-up, payment methods, processor fees, and applicable conversion rates are shown before purchase or on the Pricing page. There is no recurring subscription charge unless you separately opt into one in the future.

Credits are a non-transferable prepayment for the Service. They are not a bank account, deposit, security, cryptocurrency, or electronic-money product; do not earn interest; and cannot be withdrawn or exchanged for cash except where required by law. Purchased credit does not expire under the current pricing policy, but an account may still be suspended or closed under these Terms.

7. Payment processing, currency, and taxes

Payments may be handled by bank transfer, Flutterwave, Cryptomus, or another method displayed at checkout. Payment providers have their own terms and privacy practices. The checkout screen controls the final amount, currency, processor fee, and wallet credit for that transaction.

You are responsible for taxes, duties, bank charges, network fees, and currency-conversion costs that apply to your purchase. Do not initiate duplicate payments while an earlier payment is pending or under review.

8. Usage reservations and final charges

Before a model request runs, Klystrax may reserve an estimated amount from your available balance. The final charge is calculated using recorded input, cached-input, and output usage at the rates applicable when the request is made. Unused reservation amounts are released after settlement.

Provider timeouts or incomplete usage data may place a request into reconciliation. Klystrax may retain the reservation while it verifies the provider outcome, then charge the confirmed amount or release the reservation. The request ledger is the primary record for usage disputes.

9. Refunds and billing disputes

Completed model usage is normally non-refundable because computing capacity is consumed when the request is processed. Except where mandatory law requires otherwise, credited top-ups and promotional credits are not redeemable for cash. We will review duplicate payments, confirmed processing errors, unauthorized transactions, and other valid claims case by case.

Report a billing issue promptly to hi@klystrax.com with your account email, payment or request ID, amount, date, and payment method. Never send a password, full API key, one-time code, private wallet key, or complete card details. These Terms do not limit any refund or consumer right that cannot lawfully be excluded.

10. Free credits, promotions, and referrals

Free testing credit, promotional credit, and referral rewards may be changed, paused, or withdrawn before they are earned. Eligibility rules shown with an offer apply in addition to these Terms. Promotional credit has no cash value and may be removed when obtained through fraud, duplicate accounts, self-referral, chargeback, or other abuse.

Referral percentages and release periods are set in the account dashboard. Rewards are credited only for qualifying, settled, non-refunded payments and may be reversed if the underlying payment is refunded or disputed. Referrers must not make misleading claims or send unlawful spam.

11. Acceptable use

You may use the Service only in compliance with applicable law and third-party rights. You must obtain all rights and permissions needed for content, personal data, software, or credentials you submit.

  • Do not steal or share credentials, evade payment, interfere with usage records, or gain unauthorized access to accounts, systems, or data.
  • Do not disrupt the Service through malware, denial-of-service activity, abusive automation, vulnerability exploitation against systems you do not own or have permission to test, or attempts to bypass technical safeguards.
  • Do not use the Service to violate privacy, intellectual-property, consumer-protection, export-control, sanctions, or other applicable laws.
  • Do not present AI output as verified professional advice or use it for a high-impact decision without appropriate qualified human review.
  • Do not use the Service to exploit or endanger minors or to facilitate fraud, deception, or unlawful harm.

12. Your content and AI output

You retain any rights you have in prompts, files, tool definitions, and other material you submit (“Customer Content”). You grant Klystrax a limited, worldwide license to host, copy, transmit, transform, and otherwise process Customer Content only as reasonably necessary to operate, secure, support, and improve the Service and comply with law.

As between you and Klystrax, and to the extent permitted by law and upstream-provider terms, you may use model output for your lawful purposes. AI output may not be unique; other users may receive similar material. You are responsible for reviewing output, obtaining any necessary rights, and deciding whether and how to use it.

Klystrax does not use Customer Content to train its own models. Customer Content is sent to model and infrastructure providers as described in the Privacy Policy, and their processing may be governed by Klystrax’s provider arrangements.

13. Klystrax intellectual property

Klystrax and its licensors own the Service, branding, software, documentation, interfaces, and other materials we provide, excluding Customer Content and model output. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while your account is active; they do not transfer ownership of Klystrax technology or branding.

14. Third-party services

The Service depends on model gateways, model developers, hosting and delivery networks, email services, payment processors, search services, and compatible third-party clients. Klystrax is not responsible for a third party’s independent products, content, availability, or policies. Your use of those services may be subject to separate terms.

15. Suspension, termination, and account closure

We may restrict or suspend access when reasonably necessary to protect the Service or a user, investigate fraud or a security incident, address non-payment, comply with law, or respond to a material breach. Where practical, we will explain the restriction and provide a way to request review.

You may stop using the Service at any time and request account closure through hi@klystrax.com. Closure does not erase obligations or records that must be retained for billing, fraud prevention, dispute resolution, security, or legal compliance. We may terminate inactive or discontinued accounts after reasonable notice, subject to applicable law and the treatment of any remaining purchased credit.

16. Disclaimers

The Service and all model output are provided “as is” and “as available.” To the maximum extent permitted by law, Klystrax disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

AI output can be incorrect, incomplete, biased, offensive, insecure, or outdated. Verify code before execution and use qualified human review for matters involving health, safety, employment, credit, housing, education, legal rights, finances, or other significant consequences.

17. Limitation of liability

To the maximum extent permitted by law, Klystrax will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption arising from the Service or model output.

Klystrax’s aggregate liability arising from the Service will not exceed the greater of USD 100 or the amount you paid to Klystrax during the three months immediately before the event giving rise to the claim. These limitations do not apply to liability that cannot lawfully be limited or excluded, and they do not reduce mandatory consumer rights.

18. General terms and disputes

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; Klystrax may transfer it as part of a merger, reorganization, or sale of the Service, subject to applicable law.

Before starting formal proceedings, contact hi@klystrax.com and allow a reasonable opportunity to resolve the dispute informally. The laws and courts that apply are determined by mandatory law and the place where the Klystrax service operator is legally established; mandatory rights in your country remain unaffected.

19. Changes and contact

We may update these Terms to reflect changes in the Service, providers, law, or risk. The current version and effective date will remain available here. We will provide reasonable notice of material changes when required. Changes do not retroactively alter rates for completed requests.

Questions, notices, account-closure requests, and claims may be sent to hi@klystrax.com or +234 704 852 3145. Email is the preferred channel for requests requiring a written record.
